1. About SAFE and the scope of this notice
1.1 This Risk Warning applies to your use of SAFE TradeDesk, the SAFE website, and SAFE’s services. It is issued by Securities and Financial Engineering (S.A.F.E) Limited, a company incorporated in England and Wales under company number 04715634 (“SAFE”). Please read it together with our Terms and Conditions, our Legal Notices, and the software licence.
1.2 SAFE provides software and professional and technology services on a purely non-financial, non-regulated basis. SAFE is not authorised or regulated by the Financial Conduct Authority. SAFE is not a broker, dealer, investment firm, exchange, trading venue, or counterparty, and does not hold client money or client assets.
1.3 SAFE does not provide financial, investment, trading, tax, legal, or other professional advice, and nothing SAFE provides should be taken as such. SAFE does not offer, arrange, execute, or recommend any trade, transaction, investment, or financial product.
2. The software and services are tools, not advice
2.1 SAFE TradeDesk and SAFE’s services are tools intended to support your own operations and decisions. Any output, analytics, calculation, indicator, configuration, or data that they produce or display is for your own use, is not advice or a recommendation, and does not constitute an offer, solicitation, or inducement to enter into any transaction.
2.2 SAFE does not guarantee any result, profit, performance, saving, or protection from loss arising from your use of the software or services. You must not rely on them as the sole basis for any trading, investment, commercial, or other decision. You remain responsible for forming your own view and for the decisions you make.
3. Trading and investment risk is your own
3.1 Any trading or investment activity you carry out is your own activity, undertaken in your own name and at your own risk. Trading and investing in financial markets carry a high degree of risk, including the risk of losing some or all of the sums involved, and may not be suitable for everyone.
3.2 Market conditions, prices, liquidity, and volatility are outside SAFE’s control. SAFE does not control, predict, influence, or guarantee any market outcome, price, or execution, and is not responsible for the results of your decisions or transactions.
3.3 You should not commit funds that you cannot afford to lose, and you should obtain your own independent professional advice, including financial, legal, tax, or regulatory advice, appropriate to your circumstances before acting.
4. Software risks and your responsibilities
4.1 Software may contain errors or defects and is not warranted to be uninterrupted, error-free, or fit for any particular purpose beyond what is set out in the software licence. Its performance depends on your own data, configuration, hardware, operating environment, and connectivity, all of which are your responsibility.
4.2 You are responsible for testing and validating the software for your intended use, for maintaining your own backups, controls, and supervision, and for checking the accuracy of any output before relying on it. The warranties and limitations that apply to the software are set out in the End User Licence Agreement and the Master Licence and Services Agreement, which prevail over this notice in the event of any inconsistency.
5. Regulated and professional users
5.1 If you are a regulated firm, a professional trading entity, or otherwise subject to legal or regulatory obligations, you remain solely responsible for your own regulatory, supervisory, conduct, and risk-management obligations.
5.2 SAFE’s services, including any trading-desk setup, configuration, risk-management, or business-development support, are support services only. They do not transfer to SAFE, discharge, or reduce your own legal and regulatory responsibilities, and SAFE does not act as your adviser, controller, or supervisor.
6. Business users
SAFE’s software and services are provided to business and professional users, and are not offered to consumers. By using them, you confirm that you are acting for purposes relating to your trade, business, craft, or profession.
7. General
7.1 The information on the SAFE website and in SAFE’s materials is general in nature and provided for general information only. It is not advice and should not be relied upon in making any decision. Please also see our Legal Notices.
7.2 Nothing in this Risk Warning limits or excludes any liability or right that cannot be limited or excluded under applicable law. This notice is governed by the law of England and Wales.
